terms of service
You must be over 18 in order to commission me. If you are commissioning art of characters you do not own, you must have permission from the owner.I am happy to communicate via DeviantART notes (NOT the chat system), Telegram/Bluesky direct messages or e-mail.PAYMENTS AND REFUNDS:Payment for digital commissions will be through a PayPal invoice sent from myself, and must be paid before work will begin. Prices will typically be in USD, but depending on country of origin conversions may be made if communicated beforehand.Payment plans are available for commissions over 250$, the terms of which will be discussed individually.To claim a YCH or enquire about a custom piece, note, e-mail or direct message me with all information/edits you want and include your PayPal address and visual references.Large wings, complicated clothing/costumes and complex designs will incur a fee. The amount will depend on the design and be discussed with you prior to starting work.A full refund is allowed if no work has been started, partial refund is available depending on how far finished work is, NO refund will be applied once commission is finished.If a chargeback is filed, your useage rights to the illustrated work will be revoked and you will be blacklisted from commissioning me in future.If I receive no response from you after I make multiple attempts to get in contact, six months has passed, and payment has been made, the commission will be considered void and no refund will be available.PAYMENTS AND REFUNDS (PHYSICAL PRODUCTS):Payment for physical products purchased online will be made through the corresponding online shop, or via PayPal invoice, or bank transfer/PayID (for Australians only).Full refunds will be available for physical products in the following situations:
-If the item arrives damaged* (scratches on the clear protective film of some items do not count as damage) and the item is returned
-If the order is cancelled before the item has shipped, by either you or myselfIf a buyer provides an incorrect address and the product is mailed and returned to sender because of this, a second shipping fee will apply and the buyer will be contacted for the correct address. Please double check you've written the correct address before purchase!*Photographic proof of damage must be provided within 3 days of receiving the product. Refund for damage only applies to products damaged in shipping or production. Refund will be applied once a valid tracking number is provided for the return.THE PROCESS:Ask about what I'll draw, I'm willing to try drawing most anything!
NOTE: I will not draw any form of hate art, eg. fascism, racism, transphobia, homophobia etc.I require a visual reference which must be flat coloured, if shaded a colour palette must be provided. I do not accept AI generated imagery as references!If you want to supply a photo reference for posing, I will happily accept it, just please make sure it's your own photo or a stock one I am allowed to use! I also accept descriptions of poses or your own sketches, no matter the skill level (even just stick figures are fine!)A sketch will be sent through for approval, please make sure everything you would like fixed is communicated before I move on, otherwise a fee for changes may apply.Minor adjustments up to 3 times of colours/markings or mistakes are allowed once piece is completed without charge, after that they will incur a fee.Turnaround time may take up to a few months due to life circumstances and my RSI, feel free to enquire about the progress of your commission if you don't hear from me after 30 days.Deadlines are happily accepted, if they are shorter than a month they will incur a fee.USEAGE AND RIGHTS OF ARTWORK:I reserve the right to refuse a commission.I reserve the rights to the artwork, my art may not be used in blockchain (NFTs, cryptocurrency etc) or AI generation related technologies.
I reserve the right to use any created images to promote my business as/in advertisements or as commission examples. Unless discussed previously with you, I will not use commissioned works for merchandise reproduction.Commissioned works must not be used for commercial work without my explicit permission. A reproduction fee will apply if merchandise is to be made from commissioned work, expense will depend on volume/type of production, and crediting myself as artist still applies.Finished work is given under a personal use license, which means you are free to repost it anywhere as long as you include a link back to my profile. You are also free to print it for personal use (mousepad, mug, keychain, etc). It does NOT allow for redistribution or commercial reproduction.Art will be posted by myself online unless an agreement is reached that it be kept private, which will incur a fee. Private commissions may not be uploaded online by either myself or you, and will not be used to promote my business in any way.Unless otherwise stated by myself, or by request of the first client, all YCH (your character here) commissions have the potential to be sold as clones. A clone is the same sketch finished for multiple different people, each one with their own character(s). Custom commissions will never be sold as clones.Cropping out/altering my signature or the piece, or claiming it as your own work is not allowed. If you wish to use the image as a profile picture, inform me and I'll provide a version suitable for it.Tracing/recolouring my art is not allowed, commissioned or personal.BLACKLISTING:Blacklisted persons may not purchase commissions or products from me, directly or indirectly through another person.
Reasons for being put on this list include refusal to pay, claiming my work as your own, tracing, behaving in an unfriendly/abusive manner etc.
